Dr. Francesco Fernus, as Data Controller, informs you pursuant to Article 13 of Legislative Decree no. 196 of 30.6.2003 (hereinafter, "Privacy Code") and Article 13 of EU Regulation no. 2016/679 (hereinafter, "GDPR") that your data will be processed in the following manner and for the following purposes: 1. Purpose of Processing The Data Controller processes personal, identifying data (e.g., first name, last name, company name, address, telephone, e-mail, bank and payment references)-hereafter, "personal data" or also "data") communicated by you in connection with the conclusion of contracts for the sale of goods. Purpose of processing Your personal data are processed: A) without your express consent (art. 24 lett. a), b), c) Privacy Code and art. 6 lett. (b), (e) GDPR), for the following Service Purposes: - to conclude contracts for the Controller's services; - to fulfill pre-contractual, contractual and tax obligations arising from existing relationships with you; - to fulfill obligations under the law, a regulation, EU legislation or an order of the Authority (such as anti-money laundering); - to exercise the Controller's rights, e.g. the right of defense in court; B) Only with your specific and separate consent (art. 23 and 130 Privacy Code and art. 7 GDPR), for the following Marketing Purposes: - to send you by e-mail, mail and/or sms and/or telephone contacts, newsletters, commercial communications and/or advertising material on products or services offered by the Owner and detection of the degree of satisfaction on the quality of services; - to send you by e-mail, mail and/or sms and/or telephone contacts commercial and/or promotional communications of third parties (e.g. business partners, insurance companies, other companies ). Please note that if you are already our customers, we may send you commercial communications relating to services and products of the Owner similar to those you have already used, unless you disagree (art. 130 c. 4 Privacy Code). Processing methods The processing of your personal data is carried out by means of the operations indicated in art. 4 Privacy Code and art. 4 n. 2) GDPR and precisely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Your personal data are subject to both paper and electronic and/or automated processing. The Data Controller will process your personal data for as long as necessary to fulfill the above purposes and in any case for no longer than 10 years from the termination of the relationship for the Service Purposes and for no longer than 2 years from the collection of the data for the Marketing Purposes. 4. Access to Data Your data may be made accessible for the purposes set forth in Art. 2.A) and 2.B): - to employees and collaborators of the Controller; to third-party companies or other entities (by way of example, credit institutions, professional firms, consultants, insurance companies for the provision of insurance services, etc.) that perform outsourcing activities on behalf of the Controller, in their capacity as external data processors. 5. Communication of data Without the need for express consent (ex art. 24 lett. a), b), d) Privacy Code and art. 6 lett. b) and c) GDPR), the Data Controller may communicate your data for the purposes referred to in art. 2.A) to Supervisory Bodies (such as IVASS), Judicial Authorities, insurance companies for the provision of insurance services, as well as to those subjects to whom the communication is required by law for the fulfillment of the said purposes. These subjects will process the data in their capacity as autonomous data controllers. Your data will not be disseminated. 6. Data transfer Personal data are stored in hard copy, hard disk and on servers managed by Sistemi S.p.A.. In this case, the Data Controller assures as of now that the transfer of data will take place in accordance with the applicable legal provisions, subject to the stipulation of the standard contractual clauses provided. 7. Nature of the provision of data and consequences of refusal to respond The provision of data for the purposes referred to in Article 2.A) is mandatory. In their absence, we will not be able to guarantee you the Services in Article 2.A). 3 On the other hand, the provision of data for the purposes of Art. 2.B) is optional. You may therefore decide not to provide any data or to subsequently deny the possibility of processing data already provided: in this case, you will not be able to receive newsletters, commercial communications and advertising material related to the Services offered by the Owner. You will, however, continue to be entitled to the Services referred to in Article 2.A). 8. Rights of the data subject In your capacity as data subject, you have the rights set forth in Art. 7 Privacy Code and Art. 15 GDPR and specifically the rights to: i. obtain confirmation of the existence or not of personal data concerning you, even if not yet registered, and their communication in intelligible form; ii. Obtain the indication of: a) the origin of personal data; b) the purposes and methods of processing; c) the logic applied in case of processing carried out with the aid of electronic instruments; d) the identification details of the owner, managers and the designated representative under Art. 5, paragraph 2 Privacy Code and Art. 3, paragraph 1, GDPR; e) the subjects or categories of persons to whom the personal data may be communicated or who can learn about them as appointed representative in the State, managers or agents; iii. a) Obtain the updating, rectification, or, if in their interest, the integration of the data; b) Request the deletion, anonymization, or blocking of data processed unlawfully, including data that does not need to be stored in relation to the purposes for which it was collected or subsequently processed; c) Receive confirmation that the actions listed in items (a) and (b) have been notified, including their content, to those to whom the data has been disclosed or communicated, except in cases where fulfilling this obligation proves impossible or would involve the use of means manifestly disproportionate to the protected right. iv. To object, in whole or in part: a) For legitimate reasons, to the processing of their personal data, even if it is relevant to the purpose of collection; b) To the processing of their personal data for the purpose of sending advertising materials, direct sales, market research, or commercial communications via automated calling systems without operator assistance, email, and/or traditional marketing methods via telephone and/or postal mail. Please note that the data subject’s right to object to direct marketing purposes using automated methods as specified above also applies to traditional methods. The data subject retains the right to exercise the right to object at any time, allowing them to receive only communications via traditional methods, only automated methods, or neither type of communication. Where applicable, the data subject also holds the rights listed in Articles 16–21 GDPR (Right to Rectification, Right to Erasure, Right to Restriction of Processing, Right to Data Portability, Right to Object), as well as the right to file a complaint with the Supervisory Authority. 9.
